Acceptable Use Policy

Effective Date: January 1, 2024

1. Introduction

This Acceptable Use Policy (“AUP”) outlines acceptable and unacceptable use of the services provided by Next Dimension Inc (“ND”). This includes Managed Services, Connectivity Services, Private Cloud Services and Colocation Services. All users of ND services (“Users”) must comply with this AUP.

2. Purpose

The purpose of this AUP is to ensure the integrity, security, and reliability of the ND’s services. By using the ND’s services, Users agree to comply with this AUP and all applicable laws and regulations.

3. Prohibited Activities

Users may not use ND’s services to engage in any of the following activities:

3.1 Illegal Activities

  • Engaging in any activity that violates local, provincial, national, or international law or regulation.

3.2 Harmful Activities

  • Transmitting, distributing, or storing any material that is abusive, harassing, defamatory, libelous, obscene, or otherwise objectionable.

3.3 Security Violations

  • Engaging in activities that may interfere with or disrupt the integrity or performance of the ND’s network, systems, or services, including but not limited to hacking, distributing viruses, worms, or other malicious code.

3.4 Unauthorized Access

  • Attempting to gain unauthorized access to ND’s network, systems, or services, or any other accounts, computer systems, or networks connected to the ND’s services.

3.5 Intellectual Property Infringement

  • Using ND’s services to infringe on the intellectual property rights of others, including but not limited to the unauthorized copying or distribution of copyrighted material.

3.6 Spam and Unsolicited Communications

  • Sending or facilitating the sending of unsolicited bulk or commercial messages (“spam”).

3.7 Network Abuse

  • Conducting port scans, network probes, or other activities intended to gather information for malicious purposes.

4. Colocation Services

4.1 Physical Security

  • Users must comply with ND’s security policies and procedures when accessing colocation facilities.
  • Users are responsible for securing their equipment and data within the colocation space.

4.2 Environmental Requirements

  • Users must not tamper with or alter ND’s environmental control systems, including HVAC and power distribution units.

5. Internet Services

5.1 Bandwidth Usage

  • Users must comply with the bandwidth usage limits specified in their service agreements. Excessive usage that affects the network performance for other Users may result in additional charges or suspension of services.

5.2 IP Address Allocation

  • IP addresses provided by ND are non-transferable and must be used solely for the purpose specified in the service agreement.

6. Managed Services

6.1 Data Protection

  • Users must ensure that all data stored or transmitted via the ND’s managed services is adequately protected with encryption and access controls.

6.2 Service Integrity

  • Users must not interfere with the ND’s ability to manage and maintain the services provided.

7. Enforcement and Consequences

7.1 Monitoring and Reporting

  • ND reserves the right to monitor User activities to ensure compliance with this AUP. Any suspected violations should be reported to abuse@nextdimensioninc.com.

7.2 Violations

  • Violations of this AUP may result in immediate suspension or termination of services, and Users may be subject to legal action.

7.3 Liability

  • ND is not liable for any damages, direct or indirect, that result from User violations of this AUP.

8. Modifications

ND reserves the right to modify this AUP at any time. Users will be notified of significant changes via email or through a notice on ND’s website.

By using the ND’s services, Users acknowledge that they have read, understood, and agree to comply with this AUP.
